What really happens if you use a fishing drone in Texas today?


If you've been wondering whether it's still legal to use a drone for fishing in Texas, you're not alone. Over the past few months, we've seen countless discussions across Texas fishing groups, and talked directly with dozens of local SwellPro drone owners. Almost everyone reported the same experience:

When Game Wardens encountered anglers using drones to drop bait along the Texas coast, they didn't intervene. No warnings, no fines, no confiscations.

So, what's really happening out there? Let's take a closer look.


What Are Texas Game Wardens Actually Saying?


In a recent episode of Beach Bomber Fishing (July 1st  2026), we finally got to see a real encounter. At San Luis Pass, Carlos was flying his SwellPro FD3 to drop bait for redfish when a warden walked up.

Here's a quick summary of what the officer said:

  1. Drone fishing is not a violation under Texas state law.
  2. TPWD doesn't enforce it and won't refer cases to the Feds.
  3. Federally, drones could technically fall under the Airborne Hunting Act (50 CFR 19.11), but no federal agents are investigating or enforcing it.

That’s the honest reality. No one in Texas is getting ticketed for drone fishing.


Where the Confusion Came From?


It all traces back to a law written long before modern drones existed.

  • The original Airborne Hunting Act (AHA) enacted in 1956, aimed at stopping pilots from shooting or harassing animals out of aircraft. In that era, "aircraft" refer to airplanes and helicopters.
  • In 2017, recreational anglers started using SwellPro drones to drop bait along the coast of Texas.
  • In November 2025, suddenly a few anglers asked TPWD "is drone fishing legal in Texas?"
  • In December, TPWD consulted federal authorities, who loosely interpreted the AHA as covering drones, and said "Yes"! But soon after, they clarified that this is not a state regulation, and they won't enforce it

As of July 2026, no federal agency has publicly confirmed that drones are “aircraft” under the 1956 Act.


Can You Fly A Fishing Drone in Texas Right Now?

Short answer: Yes, people do it everyday.

Longer answer: It's a legal gray area that no agency is touching. TPWD has openly said it doesn't enforce drone fishing, and the U.S. Fish & Wildlife Service are not monitoring it.
That means if you're a responsible angler using a drone to drop bait, stay safe, and follow local fishing limits, you're operating like hundreds of Texans each week.
